These general terms and conditions of sale apply to all services sold by SAS LVF HOLIDAYS for the Wisplash park, Lac des Vieilles-Forges, 08500 Les Mazures, France.

Article 1 — Conditions of access
Access to the aquapark is open to anyone in good physical health, aged 7 or over and able to swim. Children aged 7 to 9 must be accompanied by at least one adult on the structures. Wearing the buoyancy aid, provided and included in the price, is compulsory.
Access is forbidden to anyone under the influence of alcohol, drugs or medication that impairs alertness. Each participant undertakes to hold civil liability insurance.
Services are paid in full before the activity starts: on site in cash, by cheque, by bank card and by ANCV holiday vouchers; online, by bank card only. All participants take note of the park rules displayed at the entrance and receive a safety briefing.
Article 2 — Right of exclusion
LVF Holidays reserves the right to exclude, without refund, anyone:
- behaving in a way that is dangerous to themselves,
- endangering the safety of others or of the lifeguards,
- not complying with the park rules or the team’s instructions,
- who has accessed the activity without paying for it.
Article 3 — Sessions, late arrival and cancellations
Duration
An aquapark session lasts one hour, with no re-entry. Please arrive 15 minutes before your booked time.
Late arrival
If you arrive late, the session is neither extended nor postponed, and no refund is due. No refund can be considered when customers have chosen the wrong date or time, as they enter this information themselves.
Leaving early
You may leave the session at any time; the remaining time can be neither carried over nor refunded.
Changes by the customer
Any request for a change must be made no later than 72 hours before the booked date. Our team will do its best to offer another slot; if none is available, no refund can be claimed.
Cancellation by Wisplash
The park reserves the right to cancel a session in bad weather (storm, strong wind, water quality) or for emergency maintenance. Another time is then offered; if no date suits, the service is refunded in full. If the session is interrupted after more than half of its time, a credit note is issued for the part not used, valid during the current year.
Article 4 — Online bookings
Customers choose the date and time of their session and pay the full amount by secure payment. They receive an acknowledgement that serves as confirmation and allows them to come to the park.
No right of withdrawal: in accordance with Article L.221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure activities provided on a specific date or during a specific period. Dated tickets are neither taken back, exchanged nor refunded, except in the cancellation cases provided for in Article 3.
For undated services (gift vouchers in particular), customers have fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, in accordance with Article L.221-18 of the same code.
Article 5 — Groups, companies and events
Booking is recommended for 10 people or more and compulsory for supervised groups (schools, holiday centres, works councils, hen and stag parties, team building).
A quote is sent by email; the customer returns it signed as approved. The booking becomes firm on receipt of a 30% deposit of the total amount. The balance is paid on the day of the service. Payment by administrative order is accepted for public bodies. On the day, the amount is adjusted to the actual number of participants.
Article 6 — Additional services
Cancelling additional products or services (food, drinks, private hire, entertainment) less than 72 hours before the scheduled date results in the loss of the whole corresponding order.
Article 7 — Liability and personal belongings
The park is supervised by qualified lifeguards. The activity remains subject to compliance with the instructions; LVF Holidays cannot be held responsible for the consequences of failing to comply.
Changing rooms and lockers are available. LVF Holidays accepts no liability for loss, theft or damage to personal belongings, in particular glasses, jewellery and phones taken onto the structures.
Article 8 — Personal data
The information collected when booking is necessary to process it. It is processed by LVF Holidays, the data controller, and by its technical service providers acting as processors. In accordance with the GDPR, you have the right of access, rectification, erasure, restriction, objection and portability: contact@wisplash.fr. You may also contact the CNIL (French data protection authority).
Article 9 — Complaints, mediation and applicable law
For any complaint, please contact us first at contact@wisplash.fr: most situations are settled in a few exchanges.
Consumer mediation
Any complaint must first be sent to LVF Holidays customer service, as set out in these general terms and conditions of sale. If the answer is negative or if there is no answer within 60 days of sending the written complaint, the consumer may refer the matter free of charge to the consumer mediator to which the business belongs:
